Surprise - EPA Tells Court to Withdraw Approval for Dow's Agent Orange Herbicide

(The Best Years in Life) After decades of rubber stamping registrations and approvals for harmful chemicals used in agriculture, one came to a screeching halt, albeit after the fact of registering Dow Agrochemical's Enlist Duo, their herbicidal solution to increasing weed resistance to Monsanto's Roundup herbicide that combines glyphosate with 2,4-D, a chemical component of Agent Orange.

Roundup's active ingredient includes the notorious glyphosate, declared a “probable carcinogen” by an international committee of cancer experts assigned by the WHO (World Health Organization).

Actually, a thorough analysis of Roundup and other herbicides, headed by Gilles-Eric Séralini and colleagues at Caen University in France, concluded that the synergistic toxic effect of glyphosate with chemicals used to increase plant absorption of glyphosate was worse then glyphosate alone.

This French research team, the same one that demonstrated tumors among rats in a controversial long term study exposing Monsanto's own short term study as insufficient, had to use state of the art analysis equipment to determine what those booster chemicals are.

You see, patent rights and stupid corporate conciliatory regulations allow chemical companies to not reveal the exact combined constituents because they're considered proprietary and are protected by “trade secrets” law, designed to protect the corporations, of course. For years, the EPA has assumed glyphosate as generally safe, and they allowed trade secret law to keep them from investigating.

Various independent sources have uncovered documents proving the EPA actually knew better. Their “assumption” was considered more corrupted willful ignorance than a bureaucratic error. But that's the excuse the used when recently confronted with evidence of potential environmental, animal, and human toxicity from Dow's Enlist Duo.

Filing Damaging Information in a Lawsuit Has More Impact Than Petitioning Federal Agencies

A coalition of environmental activist and farmer groups had petitioned and filed a suit against the EPA for registering Dow's Enlist Duo herbicide. The EPA has essentially agreed to the coalition's information, revealing they have not fully reviewed Enlist Duo's range of toxic dangers to environments, other species, and humans.

Is that a big oops didn't see that? More likely they were caught willfully ignoring damning information.

Thus EPA has requested the Ninth District Court of Appeals to vacate it's current registration approval of Dow's Enlist Duo until they better understand the full extent of possible environmental hazards. So whether this is a merely a bump in the agrochemical industries' quest to poison everything or the beginning of the end of their domination remains to be seen.

Still, we can enjoy this battle victory within the long war for farm and food survival. "With this action, EPA confirms the toxic nature of this lethal cocktail of chemicals, and has stepped back from the brink," said Paul Achitoff, managing attorney for Earthjustice.

Earth Justice was one of several groups that sued the EPA for its failure to consider the impacts of Enlist Duo on threatened and endangered plants and animals protected under the Endangered Species Act. Humans aren't considered an endangered species yet. They're just getting sicker and weaker from eating Big Ag and corporate foods that rely on toxic herbicides and pesticides used for GMO plants.

Explaining Dow's Enlist Duo

For the last few years there has been growing concern over Dow's “final solution” for weed resistance to Monsanto's Roundup. It was considered necessary to include Roundup's glyphosate with 2,4-D (2,4-Dichlorophenoxyacetic acid).


Excerpts from

2,4-D’s contamination with dioxins has long been a part of 2,4-D’s history, especially as it relates to its makeup of Agent Orange.

Much of Agent Orange (2,4-D and 2,4,5-T) was heavily contaminated with 2,3,7,8-tetrachlorodibenzo-p-dioxin (TCDD) – the most potent dioxin and known carcinogen, even up to 40ppm.

2,4-D becomes contaminated with dioxins during the manufacturing process, but recent technological advancements have strived (sic) to reduce dioxin levels. However, according to EPA, little to no information is available on the levels of dioxin contamination present in 2,4-D after synthesis.

Thus, the threat of dioxin contamination remains a consequence of 2,4-D use.

According to the U.S. Geological Survey (USGS), 2,4-D is one of the 25 most frequently detected pesticides in U.S. waters.

It has already been detected in low concentrations in streams, shallow groundwater, and drinking water in both rural and urban areas in the US. (All emphasis added by author)

Now you understand why environmentalists and green food groups referred to Dow's 2,4-D as the “agent orange” herbicide. In fact, Dow combined with Monsanto to create the chemical defoliant called Agent Orange used to strip jungle canopy coverage during the Vietnam conflict.

After millions of gallons were sprayed in Vietnam, many American soldiers returned suffering from chronic diseases including cancer and neurological issues. Those who showed no signs of Agent Orange damage sometimes passed their damaged genes onto their newborns who were born with deformities.

To this day, the ecological and human damage in Vietnam from Agent Orange persists even worse than what many U.S. soldiers returning from 'Nam have experienced.

One thing that should be learned from this victory against the EPA-Dow collusion, however tentative it might be, is how it takes a group of groups, better known as a coalition, to create a dent in the corporate/government armor. The amount of money and effort required to battle monolith governmental and corporate powers is usually beyond the capacity of most individual activist groups to manage.

That's why all anti-GMO activist groups should combine with farmers' legal groups to creat a formidable coalition that won't bicker about the details and agree on essential issues and strategies, which so far appear best exercised within the court system. Forget about those corny petitions to Obama, the USDA, FDA, and EPA. They're all part of the same symbiotic corrupt system supported by mainstream media.

Just make sure to weed out the moles from industry front groups or industry itself who tend to infiltrate and even take charge. This latest victory to overturn the EPA's registration of Dow's Enlist Duo was achieved by a coalition of farmer and environmental groups led by the Center for Food Safety and Earthjustice.

On a personal level, boycott Big Ag and processed food manufacturers. Buy local small farm and/or organic produce and avoid processed foods. You'll win by getting healthier as well.
